STANDARD TERMS AND CONDITIONS OF BLACKBOARD WEBSITE USE
THESE TERMS AND CONDITIONS GOVERN YOUR USE OF THE LIVERPOOL JOHN MOORES UNIVERSITY ("LJMU") BLACKBOARD WEBSITE (http://blackboard.livjm.ac.uk/). PLEASE READ THEM CAREFULLY BEFORE USING THE WEBSITE.
1. INTRODUCTION
1.1 By accessing the LJMU Blackboard website (the "Site") you accept and agree to be bound by all of the Terms and Conditions of use and the Privacy Policy (the "Terms") applying to your use of the Site.
1.2 If you do not accept all of the Terms, you should not use the Site.
1.3 LJMU may in its sole discretion, change, modify, add to or remove part or all of these Terms at any time without prior notice and such modifications shall be effective immediately upon posting of the modified Terms.
1.4 Your continued use of the Site means that you accept and agree to any amendments to the Terms.
2. USE AND REGISTRATION
2.1 This Site is for non-commercial use by individuals who are employees or students of LJMU only.
2.2 In order to access certain parts of the Site, you will be provided with a username and password (together, "your User Details"). Your User Details are unique to you and you accept that you are solely responsible for maintaining the confidentiality of your User Details.
2.3 You are responsible for all use of the Site made through the use of your User Details. You must notify LJMU immediately if you believe that the use of your User Details has been compromised.
3. INTELLECTUAL PROPERTY RIGHTS
3.1 Except as expressly provided in these Terms, materials accessible on the Site (the "Content") are protected by rights, including copyrights, design rights, database rights and trade marks. All these rights are either owned by or licensed to LJMU or otherwise used by LJMU as permitted by applicable law.
3.2 The Content is intended for individual/personal use only. Accordingly, you may print and download extracts from the Site for your own personal use only and any commercial use of the Content is strictly prohibited.
4. ACCEPTABLE USE POLICY
4.1 The Site contains discussion boards and other interactive areas ("Interactive Areas"). LJMU does not control or own the information that users post on the Interactive Areas. However, you agree to grant LJMU an unlimited, royalty free licence to republish or otherwise use anything that you post on the Site.
4.2 You are responsible for the content of the material that you post and for any acts that occur through the use of your User Details. You agree to use the Site for lawful purposes only. In particular, you warrant that you or anyone using your User Details shall not:
(a) post or transmit any material that you do not have a right to transmit under law (for example, but not limited to, copyright);
(b) post, transmit or link to any information that is obtained in breach of confidence;
(c) post, transmit or link to any content which is obscene, defamatory, threatening, degrading or which discloses private or personal matters concerning any person;
(d) post, transmit or link to sexually explicit material;
(e) post, transmit or link to any advertising, promotional materials or other forms of solicitation, including chain mails or pyramid schemes;
(f) impersonate any person, or entity or misrepresent your affiliation with any person or entity;
(g) collect or store other users' personal data;
(h) prevent or restrict the use of the Site by other users; or
(i) violate any other applicable law or regulation while accessing and using the Site.
4.3 LJMU reserves the right at its sole discretion and without prior notice to review, remove, edit or otherwise block any material that you post or to suspend or terminate your access to the Site for violating the above provisions.
5. DISCLAIMER
5.1 Whilst LJMU tries to make sure that the Content is accurate, LJMU does not warrant the accuracy or reliability of the content.
5.2 You understand and acknowledge that information posted or transmitted by users is the sole responsibility of the person from whom the material originated. LJMU accepts no responsibility for the accuracy, completeness, or even the truth of any information posted in our Interactive Areas by our users.
5.3 The Site provides information of a general nature only and LJMU does not accept any liability for any action you may decide to take, or refrain from taking, as a result of information obtained from the Site.
5.4 LJMU does not warrant that the Site will be free of error or that the Site and the server are free of computer viruses or other harmful applications and LJMU excludes all liability attached to the same.
6. LINKS AND EXTERNAL SITES
6.1 LJMU has no control or proprietary interests in any of the web sites which are maintained by third parties which can be accessed via hypertext links from the site and cannot, therefore, make any representation as to the accuracy of any information contained in those web sites. Accordingly, LJMU excludes all liability attached to the same.
7. PRIVACY POLICY
7.1 The Site complies with relevant English data protection laws. Any personal details that LJMU collects will be dealt with lawfully and in accordance with the Data Protection Act 1998.
7.2 Unless required by law or any regulatory authority or in order to protect the rights and property of LJMU, LJMU will not sell or transfer your personal data to any third party without your consent.
7.3 LJMU reserves the right to store and use members' personal data for its own internal purposes.
8. APPLICABLE LAW
8.1 Your use of the Site and any dispute arising out of your use of the Site shall be construed in accordance with English law and be subject to the exclusive jurisdiction of the English Courts.
